This policy applies to all purchases of services made through elearningsoftware.ro’s website, administered by eLearning & Software S.R.L., based in Arad, 112 Danube Street, Arad county. Arad, J02/925/2008, CUI RO23947365.

By making an online purchase/payment on our website, you agree to this Cancellation Policy.

1. Right of withdrawal (withdrawal) – Consumers

According to G.E.O. no. 34/2014, consumers (natural persons) have the right to withdraw from contracts concluded at a distance within 14 calendar days without being obliged to justify the decision and without penalties.

1.1 Withdrawal Deadline

The withdrawal term of 14 days is calculated as follows:

· for service contracts: from the date of conclusion of the contract, i.e. the moment when the user completes the online order.

1.2 Loss of the right of withdrawal

According to Article 16 letters a and m of O.U.G. 34/2014, the consumer loses his right of withdrawal in the following situations:

· if the services were fully provided before the expiry of the 14 days and the user has expressed his express prior consent for the start of the service;

· if digital content that is not delivered on a physical medium has been provided and enforcement has commenced with the explicit consent of the consumer, who has confirmed that he or she has become aware that he or she is losing his or her right of withdrawal.

These situations typically apply to software services, digital licenses, access to digital platforms, custom configurations, and other electronic services.

2. Exercise of the right of cancellation / withdrawal

To exercise your right of withdrawal, you must send us a clear request by:

It is recommended that you include:

· full name;

· order number / transaction dates;

· date of purchase;

· purchased service.

We will confirm receipt of your withdrawal request by email.

3. Refund of amounts paid

If the withdrawal is valid and within the legal deadline:

· the refund will be made within 14 days from the receipt of the request;

· The amount will be refunded by the same payment method used for the purchase, unless otherwise requested.

If the service has already been partially provided (with your prior consent), an amount proportional to the provision made up to the time of notification of withdrawal may be retained.

4. Cancellation of services by the company

We reserve the right to cancel an order in the following situations:

· technical impossibility of providing the service;

· obvious errors in the presentation of prices or information;

· justified suspicion of fraud;

· non-payment of the value of the ordered services.

In such cases, the amounts paid will be refunded in full.

5. Lack of right of withdrawal for legal entities

The rules regarding withdrawal from the contract within 14 days apply exclusively to consumers (individuals).

For purchases made by legal entities (companies, PFA, NGOs, etc.), the cancellation of orders can only be made:

· according to the contractual agreement;

· according to the specific terms of the offer;

· through direct negotiations, at the discretion of the company.
